Returns Policy

In the event that goods purchased direct from Opticron are not what you expected, you must notify us that you wish to return them to us within 14 days. The goods should be returned in an unused condition and with the original packaging within 14 days of that notification and be accompanied by a completed Returns Form and a copy of proof of purchase.

Email Communications Policy

Unless otherwise agreed expressly in writing by a senior manager of Opticron, all email communication is to be treated as confidential and the information in that communication may not be used or disclosed except for the purpose for which it has been sent. If a recipient has reason to believe that they are not the intended recipient of this communication, they should contact the sender immediately.

WARNING: Computer viruses can be transmitted by email. Recipients should check emails and any attachments for the presence of viruses. Opticron accepts no liability for any damage caused by any virus transmitted by emails sent from the company's email domains. Unless otherwise stated in the content of the email, emails and any attachments may not be copied or forwarded without express written permission of a senior manager of Opticron. In the event of any unauthorized copying or forwarding, the recipient will be required to indemnify Opticron against any claim for loss or damage caused by any viruses or otherwise.

Employees of Opticron are expressly required not to make any defamatory statements and not to infringe or authorize any infringement of copyright or any other legal right via email communications. Any such communication is contrary to company policy and outside the scope of the employment of the individual concerned. The company will not accept any liability in respect of such a communication and the employee responsible will be personally liable for any damages or other liability arising.

No employee or agent is authorized to conclude any binding agreement on behalf of Opticron with another party by email without express written confirmation by a senior manager of the company.

Should an email communication be made for the purpose of obtaining legal advice or preparing for legal proceedings, legal privilege will be claimed accordingly.

1. Status of Terms

1.1 These terms constitute a legal document ("the Agreement") which sets out the rights and obligations of you as a purchaser ("you") and those of Opticron ("Opticron", "we" or "us") in relation to the services and products offered by us through this site. By registering for Opticron services, you agree to the terms of this Agreement and you re-affirm that agreement every time you use any of our services.

1.2 You agree to:

1.2.1 provide true, accurate, current and complete information about you as prompted by our registration form (such information being the "Registration Data"); and

1.2.2 maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Opticron has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Opticron has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the Opticron site (or any portion of it).

2. Applicable Law and Language

UK law shall govern this Agreement. You and we each submit to the exclusive jurisdiction of the UK courts in relation to disputes arising out of this Agreement.

In the event of conflict or inconsistency between the terms of the English language version of this Agreement and any translation provided by us, the English language version shall prevail.

3. Placing an order

3.1 Notice will be given before you submit an order which contains important information such as a description, price (including relevant taxes) and delivery charges of the goods or services ordered. We recommend that you print a hard copy or save a copy of the notice for your own records. You will also be sent an email confirmation of your order.

3.2 We accept Visa and Mastercard.

3.3 Goods supplied to you by Opticron will correspond with their prices and description (errors and omissions excluded). If this is not the case, you have the right to reject the goods within a reasonable time period for a full refund.

3.4 In the event that an incorrect price is shown on our website, we reserve the right to decline to fulfil the order at that price. You will be notified of this, be informed of the correct price and given the choice to proceed with the order or to cancel it.

4. Right to cancel

4.1 You have the right to cancel your order within 14 days without giving any reason. The 14 days will start the day after receipt of the goods. You must then return the goods to Opticron within 14 days.

4.2 The cancellation notice should be sent by email to Opticron and must state your name, a description of the goods or services concerned and the invoice number relating to the cancelled order. We will confirm cancellation by return email and issue a Return Merchandise Authorization (RMA) number which must be shown clearly on the outside of the returned carton.

4.3 You must take reasonable care of the goods in your possession pending their return. We will only accept returned goods with their original packaging and which do not exhibit undue signs of wear and tear. Any use of the delivered goods beyond that necessary to inspect the goods as when purchasing from a physical retail outlet will invalidate your right to cancel the contract.

4.4 The goods must be returned to Opticron, 16501-D Northcross Drive, Huntersville, NC 28078. The cost of returning goods is non-refundable.

4.5 Once notice of your cancellation has been received and we are in possession of the returned goods, we will make a refund of the contract price to the payment method used to purchase the goods. This will be done within 14 days of receipt of the returned goods.

5. Content

5.1 Opticron shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this site.

5.2 Certain links in this site will lead to sites which are not under the control of Opticron. When you activate any of these you will leave the Opticron site and we will accept no responsibility or liability for the material on any site which is not under our control.

5.3 Images are for illustrative purposes only and actual product may vary from that shown. Images should be used as guidance only as alterations to products in the process of product development or variations due to the production process may occur. Products may be pictured with accessories which are not supplied with the product but which may be available to purchase separately.

6. Limitation of Liability

6.1 Nothing in this Agreement shall affect your statutory rights as a consumer nor exclude or restrict any liability for death or personal injury arising from negligence or fraud by us.

6.2 Subject to clause 6.1, you agree that Opticron shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the internet not under Opticron's direct control including, without limitation, damage for loss of business, loss of sales, non-payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information or any other pecuniary loss (even where Opticron has been advised of the possibility of such loss or damage).

6.3 The only liabilities that Opticron can exclude are those arising from the following:

6.3.1 in cases where losses were not foreseeable to both parties when the contract was formed.

6.3.2 where losses were not caused by any breach on the part of Opticron.

6.3.3 for any business losses and/or losses to non-consumers.

7. Delivery

7.1 Orders are normally dispatched within 3 working days of receipt. If delivery cannot be made within the normal time scale you will be notified of the revised delivery date by phone or email and you will be given the option to accept that date or to cancel your order.

7.2 Delivery to addresses in the upper 48 states is free of charge for all orders over $300. For information regarding delivery charges for items below $300, please see delivery details page.

7.3 Shortages or damage must be notified within 14 days of receipt of goods. After this time it will be assumed that you have received all items (except any noted as 'to follow' or 'back ordered') in good order.

All designs, text, graphics and their selection and arrangement on this site are the copyright of Opticron and/or its content providers. As a visitor to the Opticron site you are licensed to copy electronically or to print portions of this site for your own personal, non-commercial use. Any other use of materials on this site without Opticron's prior written consent is strictly prohibited.

10. Matters Beyond Reasonable Control

Opticron shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to fire, lightning or extreme weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of internet services providers or acts of local or central Government or other competent authorities.
